These Terms of Service ("Terms") govern your use of coastalrephoto.com and the media services provided by Coastal Real Estate Photography ("Coastal," "we," "us," or "our"). By using our site or booking our services, you agree to these Terms.
Coastal provides real estate and rental media services, which may include photography, cinematic video, aerial/drone media, Matterport and 3D tours, twilight and virtual twilight imagery, virtual staging, floor plans, and property marketing materials. Specific deliverables are defined by the package and add-ons selected at booking.
Bookings are placed through our online scheduling system or by direct arrangement. You are responsible for providing safe, ready, and timely access to the property at the scheduled time. Rescheduling and cancellations are subject to our then-current policy; cancellations or no-access situations made without adequate notice may incur a cancellation fee.
Fees are due as stated at booking or on the invoice. We may withhold delivery of media until payment is received in full. Unless otherwise agreed in writing, all sales are final once media is delivered.
All photographs, video, and other media produced by Coastal are protected by copyright and remain the property of Coastal. Clients receive a license to use delivered media as set out in our Image Licensing Agreement, which is incorporated into these Terms. Website content, branding, and design are owned by Coastal and may not be copied or reused without permission.
You represent that you have the authority to commission media of the property and to grant any access required. You are responsible for preparing and staging the property prior to the session.
Our services and website are provided "as is." While we work to produce high-quality media and reliable turnaround, we do not guarantee any particular business outcome, including that a property will sell or rent within any timeframe or at any price.
To the fullest extent permitted by law, Coastal's total liability arising out of or relating to our services or these Terms will not exceed the amount you paid for the specific services giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
You agree to indemnify and hold Coastal harmless from claims arising out of your misuse of delivered media, your breach of these Terms or the Image Licensing Agreement, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Charleston County, South Carolina.
We may update these Terms from time to time. Continued use of our site or services after changes become effective constitutes acceptance of the revised Terms.
