Image Licensing Agreement — Coastal Real Estate Photography

This Image Licensing Agreement explains the rights you receive in the photographs, video, and other media ("Media") created by Coastal Real Estate Photography ("Coastal"). It applies to all Media we deliver and is part of our Terms of Service.

The short version: Coastal keeps the copyright. The agent or party who commissions a shoot receives a license to market that specific property. The license is personal to that client — other parties (builders, developers, stagers, other agents or brokerages, and vendors) need their own license to use the images.

1. Ownership of Copyright

Coastal is the sole author and owner of all Media and retains all copyright and intellectual property rights in it at all times. Delivery of Media does not transfer copyright. No work is created as a "work made for hire."

2. License Granted to the Client

Upon full payment, Coastal grants the commissioning client (typically the listing agent or property owner) a limited, non-exclusive, non-transferable license to use the Media solely to market and promote the specific property photographed. Permitted uses include the MLS listing, the client's own websites and social media, email marketing, and printed marketing materials for that property.

3. License Term

The marketing license is effective until the listing transaction closes or the listing is withdrawn, unless a longer or extended term is agreed in writing. Vacation rental and other commercial uses are licensed under extended terms (see Section 6).

4. Restrictions

The Media may not be sold, sublicensed, assigned, or transferred to any third party.
The Media may not be used to market a different property or after the license term ends.
The Media may not be altered in a way that misrepresents the property.
Copyright management information and any watermarks may not be removed except on properly licensed, delivered files.

5. Third-Party Use

Builders, developers, architects, interior designers, stagers, contractors, other agents, brokerages, and other vendors are not covered by the client's license. Any such party that wishes to use the Media — including for their own portfolio, advertising, or websites — must obtain a separate license from Coastal. We are glad to arrange affordable licensing for these uses; please contact us.

6. Rental & Commercial Licensing

Media created for vacation rental or other commercial use carries an extended commercial license reflecting use across booking platforms (such as Airbnb, VRBO, and similar) and longer publication periods. Extended-licensing terms and pricing are provided at the time of booking.

7. Coastal's Reserved Rights

Coastal retains the right to use the Media for its own portfolio, marketing, social media, competitions, and promotional purposes, and to license the Media as stock or editorial content, subject to reasonable consideration of the property and client.

8. Unlicensed Use

Use of the Media outside the scope of this Agreement constitutes copyright infringement. We approach these situations in good faith and are happy to help bring any use into compliance through licensing; unresolved unauthorized use may be subject to licensing fees and remedies available under law.
